As the success of any company depends on its employees, employment law is of major importance for both the employer and the employee.
An employment relationship has three legal sources: (1) The provisions in the employment contract, (2) the articles on (private) employment law in the Swiss Code of Obligations (art. 319 et seq. OR) and (3) the rules of public employment law.
kaelin.legal regularly advises employers on labour law issues and represents employees in employment litigation. Recent work includes advising an international group on recruitment matters in Switzerland, revising an employee handbook and assisting various SMEs on day-to-day employment law issues. Current court cases relate to the representation of an IT company against claims of former directors, the defence against monetary claims against an insurance broker and wage claims against a large trust company.
In the case of reorganization, questions regularly arise regarding collective redundancies and social plan obligations; in the case of transfers of businesses, compliance with information obligations is a priority.
